When a person is authorized with absolute general right or power to act legally with respect to the property or bank accounts or tax payments, or recording work or taking legal action against third parties, etc. by another person, it is defined as GPA.
An individual can provide a GPA for all of their properties, banking transactions, tax matters, registration, litigation, and legal matters, etc., or he may simply grant a general power belonging to a single category from above.
For example, only the power of ownership matters. This general transfer of power is extremely broad and therefore involves many risks in the event that the agent/representative is not a trusted person.
Following are some of the important points to note in relation to Registration of General Power of Attorney/Special Power of Attorney in Delhi.
1. A General/Special Power of Attorney in favor of those in blood relations such as father, mother, son, daughter, husband, wife, brother, sister for the management of property can be registered by paying nominal stamp duty and registration fee.
2. The principal and two witnesses’ along with their Aadhaar Card need to be present during the presentation of documents before the Sub-Registrar.
3. A special power of attorney or SPA in respect of a property situated in another State / outside Delhi can be registered in Delhi’s Sub Registrar Office only under some special circumstances.
